1. Acceptance of Terms
Welcome to the website and mobile application (collectively, the “Platform”) operated by The Jordan McNair Foundation, Inc. (“Foundation,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of and access to our Platform, including all content, features, products, and services offered by the Foundation.
By accessing, downloading, or using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use of the Platform immediately.
2. Purpose of the Platform
The Foundation is a Maryland-based nonprofit organization dedicated to diminishing the number of heat-related deaths among student athletes. Through our K.O.B.Y. Program, the Platform provides educational materials, courses, and certifications. Certain portions of the Platform may also facilitate donations, event registrations, or the purchase of Foundation merchandise.
3. End User License Agreement (EULA)
Subject to your compliance with these Terms, the Foundation grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the mobile application solely for your personal, non-commercial use in connection with Foundation programs.
You agree not to:
- Copy, modify, reverse engineer, decompile, or disassemble any portion of the Platform.
- Circumvent or interfere with security features.
- Use the Platform to create derivative works or competing products.
- Rent, lease, sublicense, or transfer the app to any third party.
This license is for the sole purpose of enabling you to use the Platform as provided by the Foundation, in the manner permitted by these Terms.
Violation of this license may result in termination of access without notice.
4. User Accounts
To access certain services, you may be required to create an account. You agree to:
- Provide accurate, current, and complete registration information.
- Maintain and promptly update your information.
- Keep your login credentials secure and confidential.
- Accept responsibility for all activities occurring under your account.
We reserve the right to suspend or terminate accounts that violate these Terms or are used for any unlawful or abusive purpose.
5. Prohibited Conduct (No Tolerance for Objectionable Content)
The Foundation maintains a zero-tolerance policy for objectionable content and abusive behavior.
You agree not to use the Platform to:
- Upload, post, or share any content that is defamatory, obscene, indecent, pornographic, abusive, harassing, threatening, hateful, discriminatory, or otherwise objectionable.
- Engage in conduct that violates any law, regulation, or the rights of any individual or entity.
- Impersonate another person or misrepresent your affiliation.
- Transmit any harmful code, malware, or attempt to interfere with the Platform’s operation.
- Exploit, harm, or attempt to harm minors in any way.
- Use the Platform for spam, solicitation, or unauthorized commercial purposes.
Any user who violates this policy may have their account immediately terminated and reported to the appropriate authorities if necessary. The Foundation reserves the right to remove any content or suspend access without notice for any reason it deems necessary to protect users and maintain a safe environment.
6. Payments and Donations
The Foundation accepts payments and donations through secure third-party processors, including Stripe, Square, and Bonterra (Network for Good).
By submitting a payment or donation, you agree to the terms and privacy policies of these third-party processors.
The Foundation does not store full payment card information on its servers.
All payments and donations are final unless otherwise specified.
7. User-Generated Content
Users may submit comments, testimonials, photos, or other content (“User Content”).
By submitting User Content, you grant the Foundation a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display such content for educational, promotional, and mission-related purposes.
You represent that your User Content:
- Is your original work or properly licensed.
- Does not infringe any third-party rights.
- Complies with all applicable laws and these Terms.
The Foundation may remove or disable access to any User Content deemed inappropriate, harmful, or in violation of this Agreement.
8. Intellectual Property
All content, trademarks, graphics, text, images, videos, and software on the Platform are the exclusive property of The Jordan McNair Foundation, Inc. or its licensors and are protected under applicable intellectual property laws.
You may not reproduce or distribute any part of the Platform without prior written consent.
9. Mobile App Permissions
The mobile application may request permissions to access device features such as the camera, storage, or notifications to enhance course participation and app functionality.
You can manage these permissions within your device settings; however, restricting permissions may limit certain features.
10. Limitation of Liability
To the fullest extent permitted by law, the Foundation, its directors, officers, employees, volunteers, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use or inability to use the Platform, even if advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless The Jordan McNair Foundation, Inc. and its affiliates from any claims, damages, losses, or expenses arising out of your use of the Platform, violation of these Terms, or infringement of any third-party rights.
12. Governing Law
These Terms and any dispute arising hereunder shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to conflict of law principles.
Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Maryland.
13. Termination
We may suspend or terminate your access to the Platform at any time, without prior notice, if you violate these Terms or engage in any activity deemed harmful, abusive, or inconsistent with the Foundation’s mission.
14. Changes to Terms
The Foundation reserves the right to modify these Terms at any time. Updates will be posted on the Platform and become effective immediately upon posting.
Continued use of the Platform constitutes acceptance of the revised Terms.
